1. Introduction
By purchasing a membership, coaching package, fitting session or using the facilities or services of Swing Shack (“we”, “us”, “our”), you agree to be bound by these Terms & Conditions.
These terms apply to all memberships, coaching packages, fittings, and facility use under Swing Shack.
2. Membership Types and Fees
Membership types and fees are as listed on our website and promotional materials at the time of purchase. All fees are payable in advance. Membership fees may be adjusted from time to time. Existing members will be given reasonable notice of any increase before it applies to their next renewal.
3. Payment Terms
Payments may be made monthly or annually according to the chosen package. Late payments may result in suspension of access until the account is brought up to date. You are responsible for ensuring your payment details remain current.
4. Membership Duration and Renewal
Memberships run for the period stated at the time of purchase. Memberships renew automatically at the end of each term unless you cancel in accordance with the Cancellation Policy below.
5. Cancellation Policy – Memberships
You may cancel a membership by giving written notice at least 30 days before the next renewal date. No refund is given for the unused portion of a membership term that has already started.
6. Coaching Packages
Coaching packages are sold as fixed packages of sessions. Packages must be used within the validity period stated at the time of purchase (or within 12 months if no period is stated). Sessions are non-transferable unless we agree otherwise in writing.
7. Refund Policy
7.1 Memberships
No refunds are given for cancellations part-way through a membership term.
7.2 Coaching Packages
Full refund is available only if you cancel in writing before any session has been taken and within two days of the purchase date.
Once the first session has been taken, you may request a pro-rata refund or store credit for the unused sessions only.
No refund or credit is available after 30 days or once 50% or more of the sessions in the package have been used.
Refunds (where applicable) will be processed to the original payment method within 14 business days of written approval.
Refunds will attract a R100-00 admin fee.
Store credit is valid for 12 months from the date of issue and may be used for coaching, fittings, or product purchases at Swing Shack.
7.3 General
All refund requests must be submitted in writing (email is acceptable). We reserve the right to refuse a refund where there has been a clear breach of these terms or facility rules.
8. Use of Facilities
You must follow all facility rules and staff instructions at all times. We may suspend or terminate access for misconduct, unsafe behaviour, or repeated non-compliance with the rules.
9. Guest Policy
Guests may be brought only in accordance with the guest rules and fees applicable to your membership or package. You are responsible for your guests’ behaviour and compliance with these terms.
10. Liability
You use the facilities and participate in coaching or fittings at your own risk. To the maximum extent permitted by law, Swing Shack is not liable for any personal injury, illness, or loss of or damage to property arising from the use of the facilities or services, except where caused by our gross negligence. You are liable for any damage you or your guests cause to our property, equipment, or facilities.
11. Privacy and Protection of Personal Information (POPIA)
We collect and process personal information (including name, contact details, and payment information) in order to provide services, manage memberships and packages, and comply with legal obligations.
By purchasing a membership or package or using our services, you consent to this processing.
We implement reasonable technical and organisational measures to protect your information. We only share personal information with third parties when necessary to deliver the service, to comply with the law, or with your consent.
You may request access to, or correction of, your personal information by contacting us. We retain information only for as long as needed for the purposes collected or as required by law.
You are responsible for notifying us of any changes to your personal information.
12. Changes to these Terms
We may update these Terms & Conditions from time to time. The latest version will be available on our website. Continued use of memberships, packages, or facilities after changes have been published constitutes acceptance of the updated terms.
13. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
